When did these project terms go into effect?

These Terms of Service took effect on October 13, 2026 (2026-10-13). They govern all inquiries submitted through this website, quotes issued from our studio, and subsequent design, front-end engineering, and maintenance engagements entered into with Thechiveclub.

Who is performing the work and entering into this contract?

These terms establish an agreement with Thechiveclub, trading online at thechiveclub.com, with studio headquarters at 1100 Congress Ave, Austin, Texas 78701, Austin, Texas, United States. Telephone: 512-555-0123. Email: [email protected].

Our commercial enterprise operates under Texas business registration #123456789. All web design and technical architecture is directed by lead web designer Alexey, who has been practicing interface design and front-end development professionally in Austin since 2018. Rooted in the editorial ethos of theCHIVE established in November 2008, our practice builds digital properties that keep people entertained, informed, and technically sound without agency layers.

What services does theCHIVE Club provide, and what is excluded?

We provide digital interface design, web engineering, and organic search maintenance across three specific scopes:

  • Turnkey Website Engagements: Complete bespoke web applications and editorial publications. Scope spans custom layout wireframing, responsive typography calibration, semantic HTML5/CSS3/vanilla JS development, CMS integration, hosting setup, core web vitals speed tuning, and structured data schema. Standard projects deliver within 2–3 weeks; complex platforms with extensive custom modules deliver within 3–5 weeks.
  • Hourly Web Engineering: Focused technical execution including bespoke front-end component coding, CSS architecture refactoring, layout responsiveness overhaul, page speed remediation, and third-party API wiring.
  • Maintenance & SEO Retainers: Ongoing operational support covering CMS engine and security updates, weekly Google Search Console monitoring, broken link audits, Core Web Vitals score preservation, and quarterly search optimization adjustments.

What we do not do: We do not operate physical factories or freight shipping. In the software domain, we do not deploy bloated page builders such as Divi, Elementor, Squarespace, or commercial marketplace themes that output unmaintainable script debt. We write bespoke, lightweight, accessible markup tailored to the client's editorial requirements.

How does an inquiry turn into a confirmed project, and are website prices binding?

This website is strictly an inquiry-only catalogue. Nothing is purchased or charged directly on thechiveclub.com. We do not provide an automated checkout cart or merchant credit card gateway on this site.

All prices and ranges listed on this site ($2,500–$8,000 USD turnkey; $100–$175 USD/hour; $150–$400 USD/month) are empirical baseline estimates. They are non-binding estimates intended to give business owners realistic budget parameters. A formal engagement is established through the following verified process:

  1. You submit your project parameters via our inquiry intake form (sema7e1.php) or support desk (mino431.php).
  2. Alexey reviews your technical requirements and schedules a direct scoping discussion.
  3. Our studio issues an itemized written Statement of Work (SOW) defining the exact milestone schedule, final fixed price, deliverables, and payment breakdown.
  4. Work commences only after both parties execute the written SOW and the agreed deposit milestone is remitted.

What determines the final fee, and in what currency are quotes issued?

All fees, quotes, and milestone billings are priced and invoiced exclusively in USD (United States Dollars).

Studio Pricing Benchmarks Currency: USD
  • Turnkey Website Engagements: 2,500–8,000 USD
  • Hourly Web Engineering: 100–175 USD per hour
  • Ongoing Maintenance & SEO: 150–400 USD per month

Your final turnkey project quote depends strictly on five transparent variables:

  • Page Volume: The total number of unique templates and distinct content layouts requiring design and coding.
  • Level of Customisation: The depth of bespoke micro-interactions, scroll-driven visual scenes, and tailored design token architecture.
  • SEO and Maintenance Scope: Structured keyword schema modeling, content migration audits, and long-term retainer coverage.
  • E-Commerce & Integrations: API webhooks, third-party CRM connectors, newsletter sync, and transactional endpoints.
  • Delivery Timelines: Expedited delivery windows (e.g., compressed 2-week turnarounds versus standard 3–5 week pacing).

If project requirements expand after the Statement of Work is executed (such as adding new page templates or third-party payment endpoints), revisions are handled via written change orders billed at our hourly rate of $100–$175 USD/hr with prior mutual approval.

What actions are prohibited when using this website?

When accessing thechiveclub.com, you agree to interact in good faith. You must not:

  • Deploy automated scrapers, crawlers, or harvesting tools to extract studio code, typography structures, or visual assets without prior written consent.
  • Submit abusive, automated, fraudulent, or spam submissions through the inquiry form (sema7e1.php) or support desk (mino431.php).
  • Attempt denial-of-service floods, security probing, SQL injection, cross-site scripting, or server infrastructure penetration testing.
  • Bypass, alter, or manipulate our Consent Mode v2 triggers or attempt to spoof HTTP headers.
  • Misrepresent your identity or submit project inquiries on behalf of a third party without authorization.

Violations of acceptable use may result in immediate IP banning and referral to state or federal authorities.

Who owns the intellectual property of the studio and client deliverables?

All original content on thechiveclub.com (including written editorial essays, layout structures, stylesheets, theCHIVE Club name, vector logos in assets/logo.svg, and photography) is the proprietary intellectual property of Thechiveclub, protected under United States and international copyright laws.

Client Deliverables Ownership: Upon full and final settlement of all milestone invoices specified in a written Statement of Work, full ownership of the bespoke front-end code, tailored page templates, and design system assets created for the client is transferred completely to the client. Thechiveclub retains ownership of pre-existing studio starter libraries, boilerplate scripts, and general engineering methodologies, granting the client a perpetual, worldwide, royalty-free license to use, modify, and deploy them as part of their website.

What code warranty is provided, and what is disclaimed?

30-Day Defect Warranty on Production Code

Every turnkey website delivered by Thechiveclub includes a 30-day technical warranty starting from official production signoff. During this 30-day window, our Austin studio will repair any reproducible front-end defect, broken layout breakpoint, or markup bug that deviates from the approved Statement of Work at zero additional charge.

Exclusions from Warranty: The warranty does not cover issues resulting from client modifications to source code, third-party server hosting outages, upstream API breakages (such as breaking updates to external payment gateways or social feeds), or malware introduced after server handoff.

General Website Disclaimer: Except as explicitly stated in a signed Statement of Work, this website (thechiveclub.com) and all informational materials, pricing benchmarks, and articles are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not warrant that our website will be uninterrupted or error-free.

What is the studio's limit of legal liability?

To the maximum extent permitted by applicable Texas law, Thechiveclub, its principal designer Alexey, and its agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages—including loss of profits, viral traffic fluctuations, revenue loss, business interruption, or data corruption—arising from the use of this website or deliverables created.

In all circumstances, our maximum aggregate liability for any claim arising out of or relating to this website or an engineering engagement shall not exceed the total fees paid by the client to Thechiveclub under the applicable project during the twelve (12) months preceding the event giving rise to liability, or $100 USD if no active project engagement exists.

When can access be refused or an ongoing contract terminated?

We reserve the right to restrict or terminate access to thechiveclub.com immediately and without prior notice if a visitor violates our Acceptable Use policy, attempts cyber interference, or engages in abusive behavior toward our personnel.

For active commercial engagements, either party may terminate a project upon fourteen (14) days' written notice if the other party commits a material breach and fails to remedy it within that period. In the event of early termination, the client remains responsible for payment of all hourly work performed ($100–$175 USD/hr) and milestones achieved up to the termination effective date.

What law governs this contract and where are disputes resolved?

These Terms of Service, all studio statements of work, and any dispute or controversy arising out of or relating to our business operations shall be governed by and construed in accordance with the laws of the State of Texas, United States, without giving effect to any principles of conflicts of law.

Both parties irrevocably consent to the exclusive jurisdiction and venue of the state and federal courts situated in Austin, Travis County, Texas for the adjudication of any legal proceeding or litigation arising under these terms.

How are changes to these terms communicated?

We update these Terms of Service periodically to reflect changes in legal statutes, tax regulations, or our studio service structure. Any revisions become effective immediately upon posting to this URL, with the "Effective Date" header updated accordingly.

Active retainer clients will receive written email notification at least 30 days prior to any modification affecting ongoing maintenance fees ($150–$400 USD/month) or hourly billing rules ($100–$175 USD/hour). Continued use of the website following published updates constitutes acceptance of the modified terms.
